1. Agreement to Terms

By accessing and using the RetroMonkey website and purchasing our products, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Products and Pricing

  • All prices are in Australian Dollars (AUD) and include GST where applicable.
  • Prices are subject to change without notice.
  • We use batch-based pricing with three phases: Pre-Order, In-Stock, and Clearance. The price you see at checkout is the price you pay.
  • Product images are for illustration purposes. Actual products may vary slightly.

3. Orders and Payment

  • Orders are confirmed upon successful payment via Stripe.
  • We reserve the right to cancel orders due to stock errors, pricing mistakes, or suspected fraud.
  • Pre-order items ship when stock arrives (typically 2-4 weeks from order).
  • In-stock items ship within 1-3 business days.

4. Shipping

  • Free shipping on orders over $50 AUD within Australia.
  • Standard delivery: 2-5 business days within Australia.
  • We currently ship within Australia only.
  • Risk of loss transfers to you upon delivery to the carrier.

5. Returns and Refunds

We comply with the Australian Consumer Law (ACL). You are entitled to:

  • A repair, replacement, or refund for products with major faults
  • A refund if the product is significantly different from description
  • A refund if the product does not do what we said it would

For change of mind: returns accepted within 14 days of delivery, provided the product is unopened and in original condition. Return shipping is at your cost.

6. Warranty

All products carry a 30-day warranty against manufacturing defects from the date of delivery. This is in addition to your rights under the ACL, which may provide protections beyond this period.

7. Product Disclaimer

Our retro gaming handhelds come pre-loaded with games. Users are responsible for ensuring they have the right to use any software pre-installed on the devices. RetroMonkey does not hold licences for the games pre-loaded on these devices and sells the hardware only.

8. Intellectual Property

All content on this website (text, images, logos, design) is the property of RetroMonkey or its licensors. You may not reproduce, distribute, or create derivative works without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, RetroMonkey's liability for any claim arising from the use of our website or products is limited to the amount you paid for the product. Nothing in these terms excludes or limits rights under the Australian Consumer Law.

10. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.

11. Changes to Terms

We may update these terms from time to time. Continued use of the website after changes constitutes acceptance of the new terms.
